Mumbai : The very Kind-Hearted NIA says to Bombay HC that it has no objection if terror accused Pragya Thakur is granted bail.
NIA(National Investigation Agency) , probing the 2008 Malegaon bomb blast case, today told the Bombay High Court that it has no objection if the HC grants bail to Malegaon blast accused Sadhvi Pragya Singh Thakur.
Anil Singh who is Additional Solicitor General , appearing from NIA, said NIA team has already held that the provisions of stringent Maharashtra Control of Organised Crime Act (MCOCA) are not applicable in the case.
A division bench of Shalini Phansalkar-Joshi and Justices R V was hearing Sadhvi appeal challenging a sessions court order rejecting her bail.
Maharashtra Anti Terrorism Squad (ATS) who did initial investigation on this case, had applied MCOCA on the ground that the accused persons were involved in other blasts also and hence were part of an organised crime syndicate. But, NIA has removed ATS probes of MCOCA and prasented as the accused persons were only involved in Malegaon blast and hence MCOCA is not applicable,” Singh said.
Earlier in 2015, Rohini Salian, Special Public Prosecutor in the case related to the Malegaon 2008 blasts in which four Muslims were killed during Ramzan and in which Pragya Thakur is one of the accused, has said that since “the new government came to power,” she has been under pressure from the National Investigation Agency (NIA) to go “soft” in the case. She had later denotify herself from the case.
“Even before NIA took over the probe from ATS, many prime witnesses have changed their statements and complained to NIA that they were forced by ATS for their statements. By looking at all this, we (NIA) have no objection to the court granting bail to applicant (Sadhvi),” he said.
Trial of this case may take a long time to commence and conclude. The charges are yet to be framed in the case. The applicant is a woman who is suffering from a terminal disease, So, it would be great for the court to grant her bail with whatever conditions it wishes to impose on her,” said the Bail plea.
In Bail plea It further alleged that the ATS probe was a tainted one with several witnesses retracting their statements, The Bombay HC will hear the Bail plea again on January 31.
In September 29, 2008, A bomb kept in a motorcycle dikki had exploded in Malegaon , which has killed seven people and injuring around 100.
According to the investigating agencies, the blast was carried out by right-wing extremists and a total of 11 persons are at present in jail in the case, including Lt Col Prasad Purohit and Sadhvi.
